Welcome to Café D’Sevilla. These terms govern access, browsing and, in particular, the purchase of products through www.cafedesevilla.com.

By placing an order in our online store, the customer declares that they have read, understood and accepted these purchase terms.

Café D’Sevilla was created to bring a part of Seville to every cup through our coffees, our image, our products and our way of understanding the city. We also want this experience to be clear, secure and transparent from the moment of purchase until the order reaches its destination.

1. Identification of the owner

The online store www.cafedesevilla.com operates under the trade name Café D’Sevilla. The owner’s full identification details will be included in the Website’s Legal Notice. For communications about orders, returns or contracting, you may use the Contact page.

2. Purpose of these terms

These terms establish the rights and obligations applicable to purchases made through Café D’Sevilla. Placing an order constitutes acceptance of these terms.

Certain products, promotions, services, campaigns or sales to professionals may have additional specific terms. Where applicable, these will be shown before the purchase is completed.

3. Private and professional customers

Café D’Sevilla sells products to individual consumers and users as well as businesses, self-employed professionals, hospitality establishments, distributors, retailers and other professional customers.

Where the buyer acts as a consumer or user, all rights recognized by consumer protection regulations apply. Where a purchase is made within a business or professional activity, specific commercial terms, professional prices, minimum quantities, distribution systems or other B2B conditions previously communicated to the customer may apply.

4. Products

Café D’Sevilla primarily sells coffee and products related to our brand, Seville and the experience associated with enjoying coffee.

Each product page will show, as appropriate, its name, images, description, format or weight, varieties, characteristics, ingredients or composition, food information, price, promotions and applicable specific terms.

Photographs aim to represent products as faithfully as possible. However, small differences in color, presentation, printing, packaging or finish may arise from the screen used, design changes or successive product editions, provided they do not affect essential characteristics.

5. Availability

All orders are subject to availability. If a product becomes unavailable after purchase, Café D’Sevilla will inform the customer as soon as possible.

If the purchased product cannot be supplied, the customer may, where feasible, wait for restocking, accept an alternative product with prior agreement, or cancel the affected product and receive the corresponding refund. We will never substitute a different product without informing the customer beforehand.

6. Prices, taxes and charges

The prices shown in the store are those in effect when the order is placed. Before confirming the purchase, the customer can see product prices, applicable taxes, shipping costs and the total transaction amount.

Professional customers may have B2B prices different from those for final consumers.

Café D’Sevilla may change prices at any time. Changes will not affect orders already properly confirmed.

7. Offers and promotions

Café D’Sevilla may offer promotions, discounts, promotional codes, special packs or limited-time offers.

Unless expressly stated otherwise, promotions cannot be combined, are subject to availability, must be used within their validity period, cannot be exchanged for cash and may be limited to certain products, customers or quantities.

8. Purchasing process

To make a purchase, the customer must select the desired products and add them to the cart. Before completing the order, they can review products, quantities, prices, discounts, taxes, shipping costs and the total amount.

The customer must provide the information necessary to process, invoice and deliver the order. Before paying, they can correct errors or change the cart’s contents.

The purchase is concluded when the customer completes payment and Café D’Sevilla confirms receipt of the order.

9. Accuracy of information

The customer is responsible for providing complete, correct and current information, especially their identity, delivery address, postal code, city, country, telephone number, email address and billing details.

Café D’Sevilla is not responsible for delays or failed deliveries resulting from incorrect or incomplete customer information. Additional costs caused by errors attributable to the buyer may be charged where legally permitted.

10. Payment methods

Available payment methods are those shown during checkout. All payments must be authorized by the relevant financial institution or payment service provider.

Café D’Sevilla does not directly store complete bank card details when payment is handled through an external gateway. If the issuing institution rejects a transaction, the order will not be considered properly paid.

11. Payment security

Café D’Sevilla uses technical systems and payment providers intended to provide a secure transaction environment. Payment data may be processed directly by banks or specialized payment service providers subject to their own security systems and terms.

12. Order confirmation

After successfully completing the purchase, the customer will receive an electronic confirmation with the essential transaction information and must report any error as soon as possible.

Automatic acknowledgment does not prevent Café D’Sevilla from canceling a transaction for a justified reason, such as an obvious pricing error, fraud or reasonable suspicion of fraud, inability to process payment, a permanently unavailable product, an evident technical error or practical inability to deliver. If payment has already been collected, the corresponding amounts will be refunded.

13. Shipping

Available destinations, carriers, delivery methods and prices will be shown during checkout. Charges may depend on destination, weight, volume, number of products, transport method and total order amount.

14. Delivery times

Times stated in the store are estimates unless a guaranteed delivery date is expressly specified. The period begins when the order has been properly confirmed and paid.

Non-working days, holidays, high-demand periods and extraordinary circumstances may affect transit times. Unless another period has been agreed, consumer orders will be fulfilled within the maximum period set by applicable law.

15. Receiving an order

The customer should check the package on receipt. If the packaging shows visible damage, impacts, breakage, opening or signs of tampering, we recommend recording this with the carrier where possible, photographing the packaging before opening it, photographing the affected product and reporting the issue to us promptly.

These recommendations help manage the issue and do not limit the consumer’s legal rights.

16. Damaged, incorrect or defective products

If the product received was damaged in transit, does not match the order, is defective or has any conformity issue, the customer should contact Café D’Sevilla, providing where possible the order number, an explanation and photographs of the product and packaging.

The remedy required by applicable law will be offered, which may include replacement, a refund, a price reduction or another legally prescribed measure. Rights arising from lack of conformity are independent of the right of withdrawal.

17. Right of withdrawal

Where the buyer legally qualifies as a consumer or user, they generally have 14 calendar days to withdraw from a distance purchase without giving a reason.

The period generally begins on the day the consumer or a third party they designate, other than the carrier, takes physical possession of the order. If one order is delivered separately, the legally prescribed rules for calculating the period apply.

To exercise this right, the customer must clearly communicate their decision through the Contact page or another contact method provided by Café D’Sevilla for that purpose.

18. Conditions for returns following withdrawal

After notifying withdrawal, the customer must return the products within the applicable legal period, suitably protected and with all their constituent parts.

The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The customer bears the direct return costs of exercising withdrawal unless Café D’Sevilla expressly states otherwise or the business is legally required to bear them.

19. Exceptions to the right of withdrawal

Withdrawal does not apply in cases excluded by current law. These may include goods made to customer specifications or clearly personalized, goods liable to deteriorate or expire rapidly, sealed goods unsuitable for return for health protection or hygiene reasons once unsealed, and other goods or services expressly excluded by law.

These limitations do not affect the customer’s rights where the product is defective, damaged, incorrect or does not conform to the contract.

20. Refunds

Where a refund results from valid exercise of withdrawal, Café D’Sevilla will return the amounts received within the periods established by applicable law.

Refunds are generally made using the same payment method as the purchase unless expressly agreed otherwise. Where legally permitted, Café D’Sevilla may withhold the refund until receiving the products or sufficient evidence of their return.

If the customer chose delivery more expensive than the least costly standard option available, Café D’Sevilla is not obliged to refund the additional cost of that choice.

21. Model withdrawal notice

The consumer may optionally use the following model:

To Café D’Sevilla:

I hereby give notice that I withdraw from my sales contract relating to the following order:

Order number:
Product(s):
Order date:
Date received:
Consumer’s name:
Consumer’s address:
Email address:
Date:

Any other clear communication identifying the order and the consumer’s wish to withdraw is equally valid.

22. Food products

Food products must be stored according to their packaging instructions. The customer must pay particular attention to storage conditions, best-before or expiry dates where applicable, preparation instructions, ingredient information and allergen warnings.

23. Food information and allergens

Café D’Sevilla will provide legally required food information on the product, its packaging or relevant product page. People with allergies or intolerances should carefully check this information before consuming the product and, if in doubt, contact Café D’Sevilla before ordering.

24. Coffee storage

To preserve its properties, we recommend following each product’s specific instructions. In general, coffee should be kept properly sealed and protected from moisture, heat, direct sunlight and strong odors.

Differences caused by improper storage after delivery cannot be considered original defects where it can be established that they result from those storage conditions.

25. Intellectual and industrial property

All elements of Café D’Sevilla, including the brand, trade name, logos, design, packaging, photographs, illustrations, texts, graphics, patterns, compositions, audiovisual elements and web design, are protected by applicable intellectual and industrial property law.

Use, reproduction, distribution, modification or exploitation without the owner’s authorization is prohibited except as permitted by law. Purchasing a product does not transfer rights to the brand, designs, photographs, packaging or other creative assets associated with Café D’Sevilla.

26. Website use

The user undertakes to use www.cafedesevilla.com lawfully and respectfully. Using the Website for fraudulent activities, introducing malicious code, disrupting its operation, accessing systems or data without authorization, impersonating others, placing fraudulent orders or infringing intellectual or industrial property rights is prohibited.

27. Liability

Café D’Sevilla will fulfill its obligations under applicable law. It is not responsible for non-performance arising exclusively from circumstances beyond its reasonable control, such as force majeure events, widespread essential service interruptions, disasters, transport restrictions or other extraordinary circumstances.

Nothing in these terms is intended to exclude or limit consumers’ and users’ legal rights.

28. Force majeure

Neither party is responsible for non-performance directly caused by unforeseeable or unavoidable events beyond its reasonable control. In such situations, Café D’Sevilla will inform the customer and take reasonable steps to minimize the consequences.

29. Sales to businesses and professionals

B2B transactions may be subject to specific terms on prices, minimum quantities, freight, invoicing, payment methods, discounts, distribution, exclusivity, timing and other commercial conditions.

Specific agreements between Café D’Sevilla and a professional customer prevail over these general terms for matters expressly covered by those agreements. Rights established specifically for consumers and users do not apply where the buyer acts within a business or professional activity and does not legally qualify as a consumer.

30. Invoicing

The customer must provide correct tax details when requiring an invoice. Invoices may be issued electronically under applicable rules. The customer is responsible for the accuracy of the tax details provided.

31. Customer service

For inquiries about orders, products, returns, incidents or any other purchase-related matter, you may use our Contact page.

32. Complaints

If the customer believes there has been a problem with their purchase, we recommend first contacting Café D’Sevilla so we can review the case and try to offer a solution. Consumers always retain the right to use the complaint channels and out-of-court dispute resolution procedures provided by applicable law.

33. Data protection and cookies

Personal data provided while browsing or purchasing will be processed according to our Privacy Policy. Cookies and similar technologies are governed by our Cookie Policy.

34. Changes to the terms

Café D’Sevilla may amend these terms as necessary due to legislative changes, changes to services, new payment methods, changes to shipping systems, new products or technical or operational changes.

The terms applicable to a purchase are those in force when it is concluded.

35. Partial invalidity

If any provision is declared wholly or partially void, invalid or unenforceable, this will not affect the validity of the remaining provisions.

36. Applicable law

These terms are governed by Spanish law and applicable European Union regulations.

Where the buyer qualifies as a consumer, disputes will be resolved according to the territorial jurisdiction and consumer protection rules established by current law, without these terms depriving them of their mandatory rights.

37. Acceptance of the terms

Placing an order through Café D’Sevilla means the customer declares they have read these terms, understand their content, accept the conditions applicable to the purchase and provide truthful and sufficient information to manage the order.

Our aim is to make shopping at Café D’Sevilla as simple, transparent and satisfying as enjoying what really matters afterward: coffee, Seville and the moment of sharing them.
