By placing an order in our online store, the customer declares that they have read, understood and accepted these purchase terms.<\/p>\n

Caf\u00e9 D\u2019Sevilla was created to bring a part of Seville to every cup through our coffees, our image, our products and our way of understanding the city. We also want this experience to be clear, secure and transparent from the moment of purchase until the order reaches its destination.<\/p>\n

1. Identification of the owner<\/h2>\n

The online store www.cafedesevilla.com<\/strong> operates under the trade name Caf\u00e9 D\u2019Sevilla<\/strong>. 2. Purpose of these terms<\/h2>\n

Caf\u00e9 D\u2019Sevilla primarily sells coffee and products related to our brand, Seville and the experience associated with enjoying coffee.<\/p>\n

Each product page will show, as appropriate, its name, images, description, format or weight, varieties, characteristics, ingredients or composition, food information, price, promotions and applicable specific terms.<\/p>\n

Photographs aim to represent products as faithfully as possible. However, small differences in color, presentation, printing, packaging or finish may arise from the screen used, design changes or successive product editions, provided they do not affect essential characteristics.<\/p>\n

5. Availability<\/h2>\n

All orders are subject to availability. If a product becomes unavailable after purchase, Caf\u00e9 D\u2019Sevilla will inform the customer as soon as possible.<\/p>\n

If the purchased product cannot be supplied, the customer may, where feasible, wait for restocking, accept an alternative product with prior agreement, or cancel the affected product and receive the corresponding refund. Caf\u00e9 D\u2019Sevilla does not directly store complete bank card details when payment is handled through an external gateway. If the issuing institution rejects a transaction, the order will not be considered properly paid.<\/p>\n

11. Payment security<\/h2>\n

Caf\u00e9 D\u2019Sevilla uses technical systems and payment providers intended to provide a secure transaction environment. Payment data may be processed directly by banks or specialized payment service providers subject to their own security systems and terms.<\/p>\n

12. Order confirmation<\/h2>\n

Automatic acknowledgment does not prevent Caf\u00e9 D\u2019Sevilla from canceling a transaction for a justified reason, such as an obvious pricing error, fraud or reasonable suspicion of fraud, inability to process payment, a permanently unavailable product, an evident technical error or practical inability to deliver. If payment has already been collected, the corresponding amounts will be refunded.<\/p>\n

13. Shipping<\/h2>\n

14. Delivery times<\/h2>\n

16. Damaged, incorrect or defective products<\/h2>\n

If the product received was damaged in transit, does not match the order, is defective or has any conformity issue, the customer should contact Caf\u00e9 D\u2019Sevilla, providing where possible the order number, an explanation and photographs of the product and packaging.<\/p>\n

The remedy required by applicable law will be offered, which may include replacement, a refund, a price reduction or another legally prescribed measure. Rights arising from lack of conformity are independent of the right of withdrawal.<\/p>\n

17. Right of withdrawal<\/h2>\n

Where the buyer legally qualifies as a consumer or user, they generally have 14 calendar days<\/strong> to withdraw from a distance purchase without giving a reason.<\/p>\n

The period generally begins on the day the consumer or a third party they designate, other than the carrier, takes physical possession of the order. If one order is delivered separately, the legally prescribed rules for calculating the period apply.<\/p>\n

18. Conditions for returns following withdrawal<\/h2>\n

After notifying withdrawal, the customer must return the products within the applicable legal period, suitably protected and with all their constituent parts.<\/p>\n

The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.<\/p>\n

The customer bears the direct return costs of exercising withdrawal unless Caf\u00e9 D\u2019Sevilla expressly states otherwise or the business is legally required to bear them.<\/p>\n

19. Exceptions to the right of withdrawal<\/h2>\n

Withdrawal does not apply in cases excluded by current law. These may include goods made to customer specifications or clearly personalized, goods liable to deteriorate or expire rapidly, sealed goods unsuitable for return for health protection or hygiene reasons once unsealed, and other goods or services expressly excluded by law.<\/p>\n

23. Food information and allergens<\/h2>\n

Caf\u00e9 D\u2019Sevilla will provide legally required food information on the product, its packaging or relevant product page. People with allergies or intolerances should carefully check this information before consuming the product and, if in doubt, contact Caf\u00e9 D\u2019Sevilla before ordering.<\/p>\n

24. Coffee storage<\/h2>\n

To preserve its properties, we recommend following each product\u2019s specific instructions. In general, coffee should be kept properly sealed and protected from moisture, heat, direct sunlight and strong odors.<\/p>\n

Differences caused by improper storage after delivery cannot be considered original defects where it can be established that they result from those storage conditions.<\/p>\n

25. Intellectual and industrial property<\/h2>\n

All elements of Caf\u00e9 D\u2019Sevilla, including the brand, trade name, logos, design, packaging, photographs, illustrations, texts, graphics, patterns, compositions, audiovisual elements and web design, are protected by applicable intellectual and industrial property law.<\/p>\n

Use, reproduction, distribution, modification or exploitation without the owner\u2019s authorization is prohibited except as permitted by law. Purchasing a product does not transfer rights to the brand, designs, photographs, packaging or other creative assets associated with Caf\u00e9 D\u2019Sevilla.<\/p>\n

26. Website use<\/h2>\n

The user undertakes to use www.cafedesevilla.com lawfully and respectfully. Using the Website for fraudulent activities, introducing malicious code, disrupting its operation, accessing systems or data without authorization, impersonating others, placing fraudulent orders or infringing intellectual or industrial property rights is prohibited.<\/p>\n

28. Force majeure<\/h2>\n

Neither party is responsible for non-performance directly caused by unforeseeable or unavoidable events beyond its reasonable control. In such situations, Caf\u00e9 D\u2019Sevilla will inform the customer and take reasonable steps to minimize the consequences.<\/p>\n

29. Sales to businesses and professionals<\/h2>\n

B2B transactions may be subject to specific terms on prices, minimum quantities, freight, invoicing, payment methods, discounts, distribution, exclusivity, timing and other commercial conditions.<\/p>\n

Specific agreements between Caf\u00e9 D\u2019Sevilla and a professional customer prevail over these general terms for matters expressly covered by those agreements. Rights established specifically for consumers and users do not apply where the buyer acts within a business or professional activity and does not legally qualify as a consumer.<\/p>\n

30. Invoicing<\/h2>\n
